2. Description of Services

Infinity Zone VR Arena provides virtual reality (“VR”) entertainment experiences, including free‑roam VR games, private sessions, parties, and events, as well as related website booking services, digital communications, and in‑venue services (collectively, the “Services”).
The Services include:

– Online and in‑person booking and payment processing.
– Access to VR gameplay sessions and related in‑venue activities.

3. Who May Use the Services

By using the Services, you represent and warrant that:
– You are at least eighteen (18) years old and capable of entering into a binding contract; or

4. Participant Eligibility, Age, and Supervision

Minimum age. Unless otherwise stated in our materials, participants must:

Minors and supervision.
– Children under thirteen (13) years of age must be accompanied on the premises by an adult who is at least twenty‑five (25) years old.
– The supervising adult is responsible for the conduct and safety of the minors in their care, whether or not the adult participates in the VR session.
– Children must not be left unattended in waiting or common areas.
If appropriate supervision is not provided, Infinity Zone VR Arena may refuse participation or ask guests to leave, without any refund or credit.
Your participation in any in‑person VR activities is also subject to our Liability Waiver and Assumption of Risk, which you will be asked to review and sign electronically before participating, and to our Cancellation and Refund Policy, both of which are incorporated into these Terms by reference.

5. Health, Safety, and Medical Conditions

Participation in VR activities is physically and visually intense and may not be suitable for everyone. By participating, you confirm that:
– You are in good physical and mental health and capable of safely engaging in light to moderate physical activity.
– You do not have any condition that would make VR use unsafe, including (but not limited to) serious heart or lung conditions, uncontrolled high blood pressure, severe vision or hearing impairments, or conditions that could be triggered by flashing lights or intense motion.
– You are not pregnant.
– You are not under the influence of alcohol, illegal drugs, or any medication that may impair your judgment, balance, reflexes, or coordination.
Individuals with epilepsy, seizure disorders, a history of fainting or loss of consciousness, or other neurological conditions that may be triggered by visual stimuli should consult a physician before participating. If you have been advised by a medical professional not to engage in intense visual or physical activities, you must not participate.
Infinity Zone VR Arena staff are not medical professionals and cannot assess your fitness to participate. You are solely responsible for determining whether you can safely take part.
Infinity Zone VR Arena may refuse or terminate participation for any guest it believes may be unable to participate safely or who fails to comply with health and safety requirements. No refund or credit will be issued in such circumstances.

6. Accessibility and Mobility

Where possible, Infinity Zone VR Arena will make reasonable efforts to accommodate guests with disabilities or mobility limitations, subject to the technical and safety constraints of the VR equipment and play environment.
If you or a member of your group uses a wheelchair or has specific accessibility needs, please contact us in advance so we can discuss available options. In certain cases, participation may be limited or unavailable if it cannot be offered safely.

7. Booking, Payments, and Pricing

Bookings may be made online through our website, by phone, or in person.
Pricing
– Prices, taxes, and fees will be displayed at or before checkout.
– Prices are subject to change at any time; the price applicable to a booking is the price displayed at the time of purchase.
Payments
– You authorize our payment processors and us to charge your selected payment method for the full amount of your booking, including any taxes and applicable fees.
– You represent that you are authorized to use the payment method you provide.
Booking confirmation
– A booking is considered confirmed when you have completed payment and received a confirmation email or on‑screen confirmation.
– You are responsible for verifying the accuracy of your booking details (date, time, number of players, and other options).

8. Cancellations, Rescheduling, and Refunds

– All bookings are non‑refundable, except where expressly stated or required by law.
– You may request to cancel or reschedule a booking up to seventy‑two (72) hours before the scheduled start time; if approved, the value will typically be provided as account credit.
– Late cancellations (less than 72 hours before the session), late arrivals, and no‑shows are not eligible for refunds or credits.

9. Arrival, Late Guests, and Session Timing

To allow for check‑in, safety briefing, and equipment fitting, you must arrive at least ten (10) minutes before your scheduled session start time.
Sessions run on a fixed schedule:
– If you arrive late, your session may be shortened, or you may be unable to join once the experience has started.
– For group bookings, if some participants arrive late or not at all, the session may proceed without them, and no partial refunds or credits will be issued.

10. Guest Conduct and Property

You agree to:
– Follow all posted rules, safety instructions, and directions from Infinity Zone VR Arena staff at all times.
– Refrain from running, pushing, striking, engaging in horseplay, or any behavior that could injure others or damage equipment or property.
– Use all equipment only as instructed.
You are responsible for any damage you cause to Infinity Zone VR Arena’s equipment, fixtures, or other property through misuse, negligence, or failure to follow staff instructions, and may be charged for repair or replacement.
Infinity Zone VR Arena is not responsible for loss, theft, or damage to your personal belongings while you are on the premises.
Infinity Zone VR Arena may refuse service, remove a guest, or terminate a session, without refund or credit, if a guest engages in unsafe, disruptive, or unlawful behavior, or fails to comply with staff instructions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF INFINITY ZONE VR ARENA AND ITS AFFILIATES FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES, THESE TERMS, OR YOUR USE OF THE WEBSITE OR FACILITIES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE SPECIFIC BOOKING OR SESSION GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
The limitations and exclusions set forth in this section apply to claims based on ordinary negligence, but do not limit liability to the extent prohibited by law for gross negligence or willful misconduct.

You agree that any legal suit, action, or proceeding arising out of or relating to these Terms or the Services shall be instituted exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction and venue of such courts.
